Tour Terms & Conditions + Release of Liability
This Agreement is made between the Customer (referred to as the “Customer”) and La Dolce Guida Srl (referred to as the “Service Provider”). La Dolce Guida Srl is located at Via Nago 6, Milano 20148, operating under P.IVA 13789090969.
Tour Inclusions: The tour includes a guided experience onboard historical vehicles, accompanied by a driver. The tour will visit scenic viewpoints, local landmarks, and/or make stops at local establishments for refreshments and snacks. VAT is included in the stated tour price.
Payment Policy: A 25% deposit is required at the time of booking to reserve the tour. The remaining balance will be charged to the card on file 14 days prior to the scheduled tour date. For bookings made within 30 days of the tour date, the full payment is required at the time of booking.
Cancellation and Modification Policy:
- Cancellation 31 days or more before the scheduled tour date: Full refund of the 25% deposit, minus any non-refundable tickets or fees, if applicable.
- Cancellations made 15-30 days before the scheduled tour date: The 25% deposit is non-refundable.
- Cancellations made 0-14 days before the scheduled tour date: A 100% penalty applies, and the remaining 75% balance is charged to the card on file 14 days before the scheduled tour date.
- Refunds are not available for no-shows, delays, services already utilized, or once the tour time has begun.
In Case of Rain or Inclemental Weather: Our vehicles are fully open and cannot be driven in the rain. We monitor the weather closely the day prior to each scheduled tour. If rain is forecast during the tour time, we will do our best to offer an alternative tour date. If rescheduling is not possible, a full refund will be provided. Cancellations due to rain will not be made more than 24 hours before a tour is set to begin.
Customer’s Assumption of Risk: The Customer acknowledges that participation in the tour involves inherent risks, including but not limited to personal injury, property damage, or loss. By signing this Agreement, the Customer voluntarily assumes all risks associated with the tour, including risks related to vehicle use, road conditions, and weather.
Limitation of Responsibility: Neither the Service Provider nor its affiliates, employees, shareholders, directors, officers, agents, or independent contractors will be held responsible for any injury, loss, death, inconvenience, delay, or damage to personal property in connection with the provision of any goods or services. While the Service Provider will take all necessary precautions to ensure the safety of the Customer during the tour, the Service Provider cannot be held liable for any injuries, accidents, or damages that occur during the tour, except in cases of gross negligence or intentional misconduct by the Service Provider. The Customer acknowledges that certain activities and experiences carry inherent risks. The Customer agrees to assume full responsibility for their own health and safety, as well as for the safety of any minors or individuals traveling with them, and releases the Service Provider from any liability associated with these activities.
Lead Booker: By making a booking with us, the person listed on the reservation ("Lead Booker") confirms that they:
- Have read and agree to be bound by these Terms and Conditions on behalf of all individuals included in the booking.
- Consent to the use of personal data in accordance with our Privacy Policy and have the authority to share such data, including any relevant special categories (e.g., health conditions, disabilities, or dietary requirements), for all individuals in the booking.
- Are over 18 years of age and, where applicable, confirm that all members of the party meet any age-related requirements for the booked services.
- Accept full financial responsibility for the booking on behalf of all other individuals on the booking.
Force Majeure & Events Beyond Our Control: In these Terms and Conditions, “Events Beyond Our Control” refers to circumstances outside our control, the effects of which could not have been avoided even with all reasonable efforts. These events may include, but are not limited to: actual or threatened war, civil unrest, terrorist activity, labor disputes, natural or nuclear disasters, severe weather conditions, floods, epidemics or pandemics, fires, closures or restrictions affecting airports, ports, or airspace, travel bans or entry restrictions imposed by authorities or other third parties, and any other government-imposed travel limitations.Unless otherwise stated in these Terms and Conditions, we are not liable for any failure or delay in fulfilling our obligations — or for any resulting damage, loss, or expense you may incur — if such failure or delay is caused by Events Beyond Our Control. This includes the inability to provide service due to such events.
Insurance: The Service Provider maintains insurance covering the vehicle(s) used during the tour, including third-party liability for accidents involving the vehicle(s). The Service Provider is not responsible for any personal injuries or property damage that may occur during the tour. The Customer is strongly advised to have adequate and appropriate travel insurance for their trip, covering any cancellation, accidents, illnesses, or property damage during the tour. It is the Customer’s responsibility to ensure the travel insurance coverage is suitable for their specific needs.
Health and Safety: The Customer agrees to follow all safety instructions and guidelines provided by the Service Provider before and during the tour. The Customer must notify the Service Provider of any pre-existing medical conditions, disabilities, food allergie or restritions, and any other health concerns that could affect their ability to participate in the tour. Children under the age of 6 are not permitted to participate. All children must be accompanied by an adult, and the adult is responsible for ensuring the child’s safety throughout the tour.Conduct During the Tour: The Customer agrees to conduct themselves in a respectful manner during the tour and follow the guide’s instructions. The Service Provider reserves the right to remove any Customer from the tour without refund if their behavior is disruptive, dangerous, or illegal.
Privacy Policy & Intellectual Property: We collect and process personal information you voluntarily provide in order to confirm your tour — including special categories of data such as information about disabilities, dietary needs, or allergies. For more details on how we handle your data, please refer to our Privacy Policy on our website. Additionally, with your prior consent, we may use and publish images or videos taken during your tour on our website or social media channels. Any photos, videos, or other media captured during the tour may be used by the Service Provider for promotional purposes, including but not limited to marketing materials, social media, and website content. The Customer grants the Service Provider permission to use such media unless explicitly stated otherwise in writing.
Complaints: If the Customer experiences any disservice or has a complaint regarding the tour, it must be immediately communicated to the Service Provider via email or phone call. The Service Provider is committed to promptly addressing and resolving the issue to the Customer's satisfaction and in accordance with the highest standards. For a complaint to be considered valid, it must be communicated on the same day the issue occurs, and its receipt must be acknowledged by the Service Provider. Complaints received after this time will not be eligible for refunds or credits, and the Customer waives any rights in this regard.
Unforeseen Circumstances: The Service Provider makes every effort to adhere to the planned itinerary; however, on rare occasions, it may be necessary to make changes to the arrangements. In cases of unforeseen circumstances — such as severe weather, government restrictions, industrial action, natural disasters, civil unrest, or any other situations beyond the control of the Service Provider — the Service Provider reserves the right to modify the itinerary and tour arrangements. The Service Provider will make every effort to offer suitable alternatives. The Customer agrees to hold the Service Provider harmless for conditions arising due to unforeseen events. In such cases, the Customer may be offered a rescheduled tour or suitable alternative arrangements.
Governing Law and Dispute Resolution: This Agreement will be governed by and construed in accordance with the laws of Italy. Any disputes arising under or in connection with this Agreement will be resolved through arbitration in Milan, Italy, with the arbitration language being Italian.Amendments: Any changes to this Agreement must be made in writing and signed by both parties. The Customer acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Agreement.
